Kotobna Terms and Conditions of Use

1. Introduction

These Terms and Conditions of Use ("Terms") govern your access to and use of the Kotobna website and mobile application ("App"). By accessing or using the App, you agree to be bound by these Terms. If you disagree with any of these Terms, you may not use the App.

2. Eligibility

You must be at least 13 years old to use the App. If you are under 13 you may not use the App without the express permission of your parent or legal guardian.

3. User Accounts

You may need to create an account to access certain features of the App. You are responsible for maintaining the confidentiality of your account information, including your password, and for all activity that occurs under your account. You agree to notify Kotobna immediately of any unauthorized use of your account or any other breach of security.

4. Permitted Use

You may only use the App for its intended purposes. You may not use the App in any way that:

• Violates any law or regulation.
• Infringes on the rights of any third party, including their intellectual property rights.
• Is harmful, offensive, or obscene.
• Interferes with the operation of the App or the servers that host it.
• Attempts to gain unauthorized access to the App or its related systems.
• Impersonates any person or entity.

5. User Content

You may submit content to the App, such as reviews, ratings, and comments ("User Content"). You retain all ownership rights to your User Content, but you grant Kotobna a non-exclusive, perpetual, royalty-free license to use, reproduce, modify, publish, distribute, and display your User Content in connection with the App. You are solely responsible for your User Content and the consequences of submitting it. You agree that your User Content will not be illegal, harmful, offensive, or obscene.

6. Intellectual Property

The App and its contents, including the text, graphics, logos, and software, are owned by Kotobna or its licensors and are protected by copyright and other intellectual property laws. You may not use any of the App's content without the express written permission of Kotobna.

7. Author Rights:

• We respect and uphold the intellectual property rights of authors and publishers.
• Users cannot upload or share content that infringes on author copyrights.
• User reviews or commentary cannot violate author copyrights or directly copy large portions of the book without proper attribution.
• We are committed to taking down infringing content upon prompt notification by the author or copyright holder.
• We adhere to international copyright laws and treaties. This includes respecting moral rights like the right of attribution and the right to prevent derogatory treatment of works. We encourage users to respect these rights and cite authors appropriately when discussing their works

8. Termination

Kotobna may terminate your access to the App for any reason, at any time, without notice. If your access to the App is terminated, you will no longer be able to use the App.

9. Disclaimers

The App is provided "as is" and without warranty of any kind, express or implied. Kotobna disclaims all warranties, including, but not limited to, warranties of merchantability, fitness for a particular purpose, and non-infringement. Kotobna does not warrant that the App will be uninterrupted, error-free, or secure.

10. Limitation of Liability

Kotobna will not be liable for any damages arising out of or in connection with your use of the App. This includes, but is not limited to, direct, indirect, incidental, consequential, and punitive damages.

11. Indemnification

You agree to indemnify and hold harmless Kotobna, its officers, directors, employees, and agents from and against any and all claims, losses, liabilities, damages, and expenses (including attorneys' fees) arising out of or in connection with your use of the App.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Arab Republic of Egypt.

13. Dispute Resolution

Any dispute arising out of or in connection with these Terms shall be resolved by binding arbitration in accordance with the arbitration rules of the Egyptian Arbitration Center. The arbitration shall be conducted in the Arabic language and shall be held in Cairo, Egypt.

14. Entire Agreement

These Terms constitute the entire agreement between you and Kotobna with respect to your use of the App.

15. Amendments

Kotobna may amend these Terms at any time by posting the amended Terms on the App. You are responsible for reviewing the Terms regularly. Your continued use of the App after the posting of amended Terms constitutes your acceptance of the amended Terms.
